Spooky name surrounds former Chesterfield town - NBC12.com ...

CHESTERFIELD, VA (WWBT) -

If you're looking for an eerie sounding location to check out on Halloween you may not have to travel very far at all. In fact, a social media application lists an ?area in Chesterfield County as the vanishing town of Screamersville.

"When I send recent text messages or check-in, like you can on Facebook, the destination that you send from always says Screamersville and I always wondered why," said Mark Umphry.

He lives in Enon, right next to one of the historic graveyards.

"It's kind of in a creepy spot. It's been there for years," he said.

Turns out, tombstones identify freed slaves from the post Civil War era who settled in the town. The area is located along Route 10 near I-295.

Diana Dallmeyer with the Chesterfield Historical Society explains how Screamersville got its name.

"These were people who lived hard lives. They were extremely poor. They learned how to party and make the best of the circumstances that they had, so a lot of screaming and revelry going on. That's one theory," Dallmeyer said.

She says there are several theories behind the name.

"The lack of modern conveniences like telephones, other ways of communication. People just hollered from porch to porch greeting their neighbors and communicating," she suggested.

Today the former community is replaced with modern houses and condos but the few graveyards that remain shed light into another theory.

"One theory is that these are the residents of the cemetery expressing themselves," Dallmeyer said.

Whatever the case, it is perhaps the only preservation of a town with a spooky name that used to be.

"The most we can do is try to record these fascinating nuggets of our county's history," she said.

"I never hear any screams though," Umphry said with a laugh.

Screamersville, Virginia also has a Facebook page where many have checked-in and are talking about on their personal pages.

Ruiz gives Guatemala 2-1 over Jamaica in qualifier

GUATEMALA CITY (AP) -Carlos Ruiz scored in the 85th minute to give Guatemala a 2-1 win over Jamaica on Friday night in a World Cup qualifier.

Luton Shelton converted a 61st-minute penalty to tie it for Jamaica after Carlos Figueroa scored in the 15th to put Guatemala up 1-0.

Guatemala tied the United States atop Group A in the semifinal round of qualifying from North America, Central America and the Caribbean. Both teams have 10 points and can advance if they draw with each other on Tuesday night in Kansas City, Kan.

Jamaica has seven points, and needs to beat Antigua and Barbuda and then hope to win a tiebreaker, probably goal differential, with the US or Guatemala on goal differential to advance to the final round of qualifying. Jamaica is even on goal differential, while the Americans and Guatemalans are each at plus-3.

Turkey cites Srebrenica in appeal for action on Syria

ISTANBUL (Reuters) - Turkish Prime Minister Tayyip Erdogan rebuked the U.N. Security Council for inaction over Syria on Saturday, saying the world body was repeating mistakes that led to massacres in Bosnia in the 1990s.

President Bashar al-Assad's forces used air strikes and artillery to bombard insurgents on several fronts in Syria, as the 19-month-old conflict risks dragging in regional powers.

Turkey is increasingly entangled after intercepting a Syrian airliner carrying what it said were Russian-made munitions for the Syrian army, infuriating Moscow and Damascus. It has led calls for intervention, including no-fly zones enforced by foreign aircraft to stop deadly air raids by Assad's forces.

But there is little chance of U.N. support for robust action. China insists any solution to Syria's crisis must come from within while Russia has said many Syrians still support Assad. Western nations meanwhile are loath to commit to any military action that could touch off a regional sectarian war.

"The U.N. Security Council has not intervened in the human tragedy that has been going on in Syria for 20 months, despite all our efforts," Erdogan told a conference in Istanbul attended by leaders including Arab League Secretary General Nabil Elaraby. "There's an attitude that encourages, gives the green light to Assad to kill tens or hundreds of people every day."

The bloodshed has worsened markedly in the past two months although neither side has been able to gain a distinct advantage, with government forces relying heavily on air power and artillery to batter the rebels.

Combat has been reported nationwide but the crucial strategic battles are being fought in an arc through western Syria, where most of the population lives.

Turkish Foreign Minister Ahmet Davutoglu met U.N. special envoy Lakhdar Brahimi, German Foreign Minister Guido Westerwelle and Libya's wartime rebel Prime Minister Mahmoud Jibril to discuss Syria on the sidelines of the Istanbul conference.

U.N. Secretary-General Ban Ki-moon said this week Brahimi would visit Syria soon to try to persuade Assad to call an immediate ceasefire.

The Syrian government dispatched warplanes to attack insurgent forces surrounding the Wadi-al-Dayf military barracks near Maarat al-Numan in Idlib province, wounding 22 rebels, the Syrian Observatory for Human Rights said.

The rebels captured Maarat al-Numan this week, cutting the main north-south highway linking Damascus, Homs and Aleppo, and government forces will need to retake it in order to reinforce and resupply Aleppo - Syria's largest city and commercial hub.

MEMORIES OF SREBRENICA

The U.N. Security Council, divided between Western powers on one side and Russia and China on the other, has proved helpless in halting a conflict which has spiraled into civil war and killed more than 30,000 people.

Erdogan said a system which allowed one or two nations to block intervention in such a grave humanitarian crisis was inherently unjust, and that Syria would go down in history as a U.N. failure much like Bosnia in the 1990s.

"How sad is that the United Nations is as helpless today as it was 20 years ago when it watched the massacre of hundreds of thousands of people in the Balkans, Bosnia and Srebrenica," Erdogan told the Istanbul conference.

The July 1995 massacre in Srebrenica was the worst on European soil since World War Two, in which Dutch U.N. peacekeepers abandoned what had been designated a U.N. safe haven to advancing Bosnian Serb forces, who then killed 8,000 Muslim men and boys and bulldozed their corpses into pits.

Turkish officials had expressed hope they might be able to persuade Moscow, which sold Syria $1 billion of arms last year, to soften its opposition at the Security Council and that if it succeeded, China would follow suit.

But relations between Ankara and Moscow sank to a new low on Wednesday after Turkey forced down a passenger jet flying from Moscow and publicly accused Russia of ferrying military equipment to Assad's forces.

Russia has said there were no weapons on the plane and that it was carrying a legal shipment of radar equipment.

Syria is banning Turkish civilian flights over its territory as of midnight on Saturday, according to a Syrian Foreign Ministry statement carried by state news agency SANA.

REBELS CONTROL BORDER TOWN, FOR NOW

Elsewhere on Syria's battlefronts on Saturday, government forces rained mortar fire down on the opposition-held Khalidiya neighborhood of the city of Homs, the Observatory said. Explosions were felt throughout the besieged district.

To the south of Damascus near Deraa - cradle of the uprising which began with peaceful street rallies - Assad's troops and rebels were fighting on the edge of the town of Maarba.

After four days of heavy fighting in the town of Azmarin on the Turkish border, the rebels appeared to have a fragile hold.

"Praise be the town is now in our hands ... We have raised two flags inside the town and the battles are over. Azmarin is completely under our control," one resident, who did not want to be named, told Reuters by telephone from inside the town.

But a few km (miles) along the border clashes continued in the Syrian town of Darkush, where the crack of gunfire and sporadic sound of shelling could be heard from Turkey.

In a preliminary death toll across the country for Friday alone, the Observatory listed about 160 dead. Among them were a 3-year-old child killed in a bombardment of old Aleppo, a district whose ancient buildings have been severely damaged.

Tensions between Ankara and Damascus have also worsened. Turkey scrambled two fighter jets on Friday after a Syrian helicopter bombed Azmarin and has warned of a more forceful response if violence continue to spill over the border after a shell from Syria killed five Turkish civilians 10 days ago.

"If similar border violations occur again, and we feel that Turkey's national security is under threat, we will retaliate without hesitation," Davutoglu said.

Syria's state news agency SANA said Damascus was ready to accept a Russian proposal for a Syrian-Turkish joint security committee to try to contain the border violence. There was no confirmation of this from the Turkish side.

Taipei Assassins take out video game Goliath, win $1M

The world's most-played video?game has a brand new world champion.

The Taipei Assassins, a team from Taiwan, has won the "League of Legends" World Championship Finals and the $1 million in prize money that goes with it.

On Saturday, the?Taipei Assassins took on South?Korean team Azubu Frost at Galen Center in Los Angeles. The finals set the two five-man teams against each other in a best-of-five competition that ended when the Taipei Assassins -- the underdogs -- beat Azubu Frost three games to one.?

?These guys --?against all the odds!" said a thrilled?Brandon Beck, CEO and?co-founder of Riot Games, as he awarded?the enormous?Summoner's Cup to the winning team. "They just showed up tonight!"

Launched three years ago, the online?multiplayer PC?game "League of Legends" -- created by Riot Games -- has emerged as an immensely popular game around the world. And it has?shot to popularity especially over the course of the last year.

Back in November 2011,?Riot reported?that the game was pulling in?4.2 million daily active?players and 11.5 million monthly players. But last week, "League of Legends" claimed?the title of "most played video?game in the world" with Riot revealing that it now?pulls in 12 million daily active players and?32 million monthly active players for a total of?1 billion hours of?play time per month.

For comparison, "World of Warcraft"?currently?has 10?million subscribers ?and "FarmVille 2" -- the most popular game on Facebook at the moment -- has?8.5 million daily active users.?

"League of Legends" -- which?is a strategy-heavy game that drops players into a fantasy-themed battle arena?-- is also a highly competitive game that has become immensely popular as an electronic sport (aka eSport).

Tickets to the?Season Two World Finals at the University of Southern California's 10?thousand-seat Galen Center?sold out in just?three days. And on Saturday evening, the USC basketball?arena was packed with cheering fans.?Meanwhile, hundreds of thousands of viewers worldwide watched the games play out online where they?were being broadcast via Twitch.tv ?and Own3D.tv?in 13 different languages.

Azubu Frost and the?Taipei Assassins emerged as the two very best teams in the world after a series of playoff games took place in Los Angeles last week pitting?12 teams?from around the world against each other. Teams arrived in L.A. from?China, Vietnam, Korea, Taiwan, North America, and Europe.

Azubu Frost and the Taipei Assassins?had never faced off before Saturday's event, but Azubu Frost went into the finals heavily favorited to win with announcers?calling it "a David and Goliath match-up."

Azubu Frost hails from Korea, where eSports are immensely popular and teams are known for their dedication and extremely high level of?skill. And Azubu Frost?had?dominated?throughout?the playoffs. They triumphed over North America's?Team SoloMid, winning 2 ?games?to 0. And in the semi-finals, they took down?European?team?Counter Logic Gaming EU 2 games to 1.

The Taipei Assassins found themselves going up against the powerful Korean?team after?surprising?everyone with two upset victories during the playoffs. They beat Korean team?Najin Sword with a 2 to 0 victory. They then took down the?Moscow Five -- a team many had predicted would win the finals -- in a?2 to 1 match-up.?

On Saturday evening with many betting on an Azubu Frost triumph, the Taipei Assassins came out strong and seemed to be ahead early on in the first game. But Azubu Frost came back to win the match, which saw a surprising number of kills -- 54 total. The Taipei Assassins then won the second game and followed that with an?even stronger third game,?forcing Azubu Frost to surrender after?22 minutes.

With momentum on their side and the crowds cheering them on, the?Taipei Assassins sealed their Summoner's Cup win and the million dollar prize?with an aggressive fourth game.

The rise of eSports
"League of Legends,' at its core, is a?competitive team game. It?s a sport. And?like any sport, fans don?t just enjoy playing it, they want to watch the game at the highest level of competition," Beck?told me during an interview before Saturday's finals.

When I asked why he thought?"LoL" had become such a popular eSport, he said, "There are a lot of skills to master and there?s a ton of depth to the experience.?It's also fun to watch for the same reason that any traditional sport might be,?which is you can be in awe of the super human feats at the highest level of play."?

Saturday's World Championship Games brought to a close what has been an exciting season of "League of Legends"?gaming?-- a season in which Riot was far more ambitious with its eSports plans for the game than ever before ...?and things were sometimes?far more complicated than ever before.

"We?re seeing tremendous growth in eSports all over the world," ?Beck said,?though he acknowledged electronic sports have not yet reached the kind of mainstream popularity?in North America that they have in?countries like South Korea.

Beck said that,?with Season 2,?Riot has tried to significantly advance the "League of Legends"?eSports experience for both competitors?and?fans.?For example, last year's?Season 1 "League of Legends" World Championship Finals were held at a far smaller gaming venue?in Sweden and the winners walked away with a?$50,000 prize. This year, Riot decided to bring?the finals?to a major sports arena and blew the winning?prize up to a cool?$1 million.?

Meanwhile, Beck said they are trying to create?broadcast and live spectating experiences?that are approaching the kind of quality and production values?found in?traditional?professional sports. With that in mind, not only were the "League of Legends" finals held before thousands of people in a sports arena, they were broadcast with the kind of well-organized, live play-by-play commentary and analysis one might see during?a pro?football game.

"We hit an inflection point at ?some point between last season and this season where the demand and interest in eSports picked up dramatically," Beck said. "And that,?in our minds, gave us a green light to go really big on realizing this?phenomenal?experience."

And Saturday's event did?seem to go off as smoothly as any event?organizer could have hoped ... though?only after Riot hit a few bumps getting there.

During the playoffs the previous week, Riot ran into technical issues that forced the company to postpone some of the?matches. The earlier games also?drew?accusations that competitors were able to cheat by stealing?glimpses of each other's maps -- all because of the way the competition stage had been laid out.

Riot ended up fining?Azubu Frost $30,000 for its screen watching behavior during the playoffs?and then?carefully redesigned the stage layout to ensure players wouldn't be tempted to peek?during the finals.

"We had a really ambitious set design that we thought would really improve the live spectator experience, but unfortunately it made it a little easier for players to get information they?shouldn't?have access to in the game," Beck said. "We take?responsibility?for creating that temptation and that possibility."

And he added, "I do think that as we sort of break new ground and try to realize our ambitious vision we are going to make some mistakes along the way. But hopefully, overall, we are providing a fantastic experience."

Certainly the enthusiastic crowds at Galen Center?Saturday night seemed thrilled with the World Finals, which offered some truly epic "League of Legends" gaming.

As for the folks at Riot, when I asked Beck what he hoped would ultimately come out?of Saturday's event, he said,?"We want to come away with proof that the notion of?eSports being broadcast to millions and played in front of thousands in a sports arena is not a dream off in the distant future but is today?s reality."

A story to celebrate on the International Day of the Girl Child

Rekha Kalindi refused to enter a child marriage at age 12 and insisted on staying in school. Her stand is helping change attitudes in part of rural India.

However,?I have a story about child marriage from my years reporting in India, that one can truly celebrate.?

But first, the startling statistics from the UN: Child marriage still happens to a third of young women globally. Pregnancy complications are the leading cause of death for girls 15 to 19 in the developing world. And child marriages cut short girls' education, while keeping girls in school longer has proven to be a key tactic to fight the problem.?

Efforts by girls to stay in school meet resistance from parents in poverty, ingrained cultural traditions, and, as we were reminded in Pakistan this week, radical Islamists. A Pakistani Taliban gunman shot twice 14-year-old Malala Yousafzai after she spoke out against the group and its efforts to shut down girls' schooling in Swat. She is recovering in a military hospital.?

In next-door India three years ago, I met Rekha Kalindi, a girl whose fight to stay in school met with less tragedy.

When?Rekha Kalindi?was nearing age 12, her parents told her they were planning to marry her off. Rekha's response would reverberate all the way up to the president of?India: "No."

Nearly half of all Indian females get married before turning the legal minimum age of 18. The requirement has been in place for more than three decades, but centuries of custom don't change overnight ? and that's especially true in Bararola, a land carved up into small farm plots and crisscrossed by dirt paths that takes at least a day's journey to reach from?Calcutta. But even here, some people are taking a stand.

Many locals eke out a living making?beedis, a leaf-wrapped Indian cigarette. Rekha was rolling?beedis?with her parents inside their mud-hut home when they broached her nuptials.

"I was very angry," says Rekha. "I told my father very clearly that this is my age of studying in school, and I didn't want to marry."

With the help of friends, teachers, and administrators, Rekha accomplished what the law alone has not. No child marriages have taken place in the surrounding villages where she and two other girls refused to marry last summer, and similar approaches are meeting some success in other regions.

Kogas to Host Gastech 2014

The 27TH Gastech Conference & Exhibition, the global meeting place for energy industry professionals, will take place at the Korea International Exhibition Centre (KINTEX) in Seoul, South Korea, from 24th -27th March 2014.

Hosted by the Korea Gas Corporation (KOGAS) Gastech 2014 will bring together thousands of conference delegates, visitors and VIPs, for what promises to be a landmark event for the global gas community, as it visits South Korea for the first time.

KOGAS is the single largest LNG importer in the world, as well as the owner and operator of three world-scale LNG regasification terminals, and a 3,000km span of nationwide transmission pipeline networks. (AP) ? For one day of the campaign, at least, President Barack Obama was just the warm-up act.

Hours before Vice President Joe Biden's lone debate with Republican running mate Paul Ryan, Obama appeared loose and at ease in a semi-backup role, his sleeves rolled up at the University of Miami as he railed against rival Mitt Romney before 9,000 screaming college students.

For once, Biden was front-and-center.

Obama's stumble in the first presidential debate against Romney raised the stakes of Biden's performance in Danville, Ky., giving the president's re-election campaign a chance to regain its stride and blunt Romney's recent rise in the polls.

Obama planned to watch the start of the debate aboard Air Force One following an evening fundraiser in Miami, one of his last of the long campaign. Aides said the president called Biden on the way to South Florida to wish him good luck.

The president made no mention of the debate during the rally, choosing instead to criticize his GOP rival and plead with students to vote early beginning on Oct. 27.

"He's trying to go through an extreme makeover," Obama said of Romney. "After running for more than a year in which he called himself 'severely conservative,' Mitt Romney is trying to convince you that he was severely kidding."

Taking a mocking tone, the president said Romney was trying to mask his past stances on tax cuts and health care. "Mitt Romney is for whatever you're for. Suddenly, he loves the middle class ? can't stop talking enough about them. He loves Medicare, loves teachers. He even loves the most important parts of Obamacare. What happened?"

Obama recited a litany of what he said are the consequences of Romney's policies, taunting that "this new version of Mitt Romney" was running away from the things he promised to do as president. "Tax breaks for outsourcers? Never heard of such a thing. Saying we should cut back on teachers? Doesn't ring a bell."

The crowd roared with delight at the tougher approach. One person in the crowd held aloft an iPad with a simple message for Obama: "Take the gloves off."

Obama's campaign said the president planned to travel to Williamsburg, Va., on Saturday for three days of practice before the next debate, when the full glare of the spotlight will return ? for good.

China's Mo Yan wins Nobel for "hallucinatory realism"

STOCKHOLM (Reuters) - Chinese writer Mo Yan won the 2012 Nobel prize for literature on Thursday for works which combine "hallucinatory realism" with folk tales, history and contemporary life in China.

Mo, who was once so destitute he ate tree bark and weeds to survive, is the first Chinese national to win the $1.2 million literature prize, awarded by the Swedish Academy.

He said the award made him "overjoyed and terrified".

Some of his books have been banned as "provocative and vulgar" by Chinese authorities but he has also been criticized as being too close to the Communist Party.

While users of a popular Chinese microblogging site offered their congratulations, dissident artist Ai Weiwei said he disagreed with giving the award to a writer with the "taint of government" about him.

Mo, 57, who grew up in the town of Gaomi in Shandong province in the northeast of the country and whose parents were farmers, sets his works mainly in the land of his birth.

Mo Yan is a pen name which means "Don't Speak". His real name is Guan Moye and he was forced to drop out of primary school and herd cattle during China's Cultural Revolution.

Speaking to the state-run China News Service, Mo said he was happy to have won.

"But I do not think that my winning can be seen as representing anything. I think that China has many outstanding authors, and their great works should also be recognized by the world.

"Next, I'm going to put most of my efforts into creating my new works. I will keep working hard, and I thank everyone. As to whether I go to Sweden to receive the prize, I will wait for word from the organizers about arrangements."

"AT HOME WITH HIS DAD"

Peter Englund, head of the Swedish Academy, said Mo was "at home with his dad" when he was told of the award.

"He said he was overjoyed and terrified," Englund told Swedish television, adding:

"He has such a damn unique way of writing. If you read half a page of Mo Yan you immediately recognize it as him."

The award citation said Mo used a mixture of fantasy and reality, historical and social perspectives to create a world which was reminiscent of the writings of William Faulkner and Gabriel Garcia Marquez.

At the same time, he found a "departure point in old Chinese literature and in oral tradition", the Academy said.

Englund said Mo offers "a unique insight into a unique world in a quite unique manner."

His style is "a fountain of words and stories and stories within stories, then stories within the stories within the stories and so on. He's mesmerizing," Englund told Reuters television.

Mo is best known in the West for "Red Sorghum", which portrayed the hardships endured by farmers in the early years of communist rule. His titles also include "Big Breasts and Wide Hips" and "The Republic of Wine".

The last Chinese-born winner was Gao Xingjian in 2000, although he was living in France by that time and had taken French citizenship. His Nobel was not celebrated by the Chinese government.

CHINA HAS "WAITED TOO LONG"

Communist Party mouthpiece the People's Daily praised the win in a commentary on its website (www.people.com.cn).

"This is the first Chinese writer who has won the Nobel Prize for Literature. Chinese writers have waited too long, the Chinese people have waited too long," it wrote.

Mo, a vice chairman of the government-backed Chinese Writers' Association, said he had nothing to say about Liu Xiabao, the jailed dissident who won the Nobel Peace Prize in 2010 and whose name has been banned from public discussion in China.

"His winning won't be of any help for Liu Xiaobo, unless Mo Yan expresses his concern for him," said Ai Weiwei.

"But Mo Yan has stated in the past that he has nothing to say about Liu Xiaobo. I think the Nobel organizers have removed themselves from reality by awarding this prize. I really don't understand it."

Beijing-based writer Mo Zhixu said Mo Yan, who once copied out by hand a speech by Chairman Mao Zedong for a commemorative book, "doesn't have any independent personality."

Yu Shicun, a Beijing-based essayist and literary critic, said Mo Yan was a puzzling choice for the prize.

"I don't think this makes sense," said Yu in a telephone interview. "His works are from the 1980s, when he was influenced by Latin American literature. I don't think he's created his own things. We don't see him as an innovator in Chinese literature."

The literature prize is the fourth of this year's crop of prizes, which were established in the will of Swedish dynamite inventor Alfred Nobel and awarded for the first time in 1901.

The writer, who was in the People's Liberation Army before progressing to academia, was one of the favorites to win the award this year, according to British bookmaker Ladbrokes, along with Japanese author Haruki Murakami.

The Academy has been charged in the past with being too Euro-centric, although the United States once again misses out with its last literature prize winner, Toni Morrison, recognized back in 1993.

  1. Prohibits the passing of a law or rule compelling an individual or employer to purchase, obtain or provide health care coverage
  2. Prohibits penalties or taxes on individuals or employers who pay directly for health care services

Approval of this amendment would give our state legislators some cover to opt out of the Medicare provision of Obama Care. You should vote for this if you believe that government has no business in compelling us to purchase health care.

CON
If you believe that government sponsored programs are the answer to our state and country?s health care problems, then you should not vote for this.

CONSTITUTIONALITY
In my opinion, if Obama Care is not repealed, then parts of this amendment will be challenged. The Supreme Court basically gave states the right to opt out of the Medicare provision of the law. However, the individual mandate remains, and I am sure a second Obama administration would attack certain provisions of this amendment as being not in compliance with federal law.

#2 VETERANS PROPERTY TAX DISCOUNT

WHAT IT DOES

Extends property tax discounts to all combat disabled veterans currently living in Florida no matter where they resided when they entered military service.

PRO
Some see this as a fairness issue. No matter what place they grew up in, we have veterans who live in Florida now who were disabled in combat while defending our country and its values. Is it not fair to give
them the same discount that combat-disabled veterans that grew up in Florida get? If you agree you should vote for this amendment.

CON
Keep in mind that whenever you grant any type of a property tax exemption to anyone, there will be a revenue price to pay. It is anticipated that local governments would lose about 2.4 million dollars in revenue in fiscal year 2013-14. If that concerns you then you should not approve this amendment.

CONSTITUTIONALITY
I suppose there is a slight chance that if the voters do not approve this amendment there might be an individual who might try to challenge the current exemption in court. In my opinion the case would be weak. States have the power to determine how they obtain revenue, and therefore the power to exempt those they choose, especially if they are backed by the consent of their citizens.

#3 STATE GOVERNMENT REVENUE LIMITATION

WHAT IT DOES

  1. Replaces current revenue limitation based upon personal income growth with a revenue limitation based upon inflation and population change
  2. Requires that revenue collected in excess of the limitation be deposited into the budget stabilization (rainy day) fund until that fund reaches its maximum balance
  3. Authorizes use of funds that exceed the stabilization fund?s maximum balance to be used for support and maintenance of public schools by reducing financial support required from school districts for participation in a state funded education finance program
  4. If no minimum support from school districts is needed, it allows for excess funds to be returned to tax payers
  5. Allows the State Legislature to increase future state revenue limitations through a bill passed by a super majority of both houses of the Legislature
  6. Allows the State Legislature to submit proposed increases to the state revenue limitation to the voters

PRO
In my opinion, this amendment would make it easier for the State Legislature to increase the state revenue limitation. Changing the way the limitation is currently determined would also increase it. Inflation has been increasing slowly but surely, and would certainly allow for an increase in revenue limitation as soon as this amendment would go into effect. So if these things appeal to you, then by all means vote for this amendment. It would make it easy to just vote for it and not have to figure out why all this is necessary. Just approve it, and let our elected officials act in our behalf.

CON
I like to use the KISS (keep it simple stupid) method for explaining things. This amendment is what is wrong with most legislation that is proposed these days in state or federal government. It is just too complicated. When I am given something to vote on, and I do not fully understand it, I usually vote no. Come back to me when you can explain why we need it better. Also I see that there are two options for getting future increases in revenue limitation approved. The State Legislature can vote it in or they may, if they choose, let the voters decide. If you are like me, and don?t mind being bothered with such things, you won?t vote for this amendment. Let them come back with a good reason why the way it is determined needs to be changed, and let the amendment require approval of the voters for any future increase and then they can have my vote.

CONSTITUTIONALITY
This should not be a concern. States are pretty much responsible for their own ways of collecting revenue and how it is used.

#4 PROPERTY TAX LIMITATIONS AMENDMENT

WHAT IT DOES

  1. Authorizes the Legislature to, by general law, prohibit the increased assessment on homestead and specified non-homestead property when the value of that property is less than the just value of that property on the preceding January 1 (subject to adjustments because of changes or additions to the property)
  2. Reduces the limitation on annual changes in assessments on non-homestead property from 10% to 5%
  3. Authorizes the Legislature to, by general law, provide an additional temporary homestead exemption for persons acquiring homestead property who have not owned homestead property in the 3 previous calendar years
    • a) Outlines provisions for calculating the temporary exemption and specifies that the property owner is not exempted from school district levies
    • b) Outlines provisions for the gradual reduction of this temporary exemption over a 5 year period

PRO
There are many aspects of this amendment that are going to appeal to a great many of our citizens. Where shall I begin? If the value of your home has taken a hit and yet your property tax bill still looks like your home is worth what it used to be, you might think that this amendment is long overdue. If you are considering buying a home for the first time, that additional tax exemption part of the bill will be appealing to you. People in the real estate business will probably like that part of the amendment too, since it might stimulate the real estate market. Owners of commercial property will probably appreciate the part that will reduce annual assessment increases from 10% to 5%. People that just don?t like taxes at all (does that leave anybody out) may see any reduction of taxes as a good thing. So if you fall in one of those categories (did I leave anybody out) you are probably going to vote yes for this amendment. There have been some straw polls conducted around the state concerning just this amendment.

Generally speaking, the majority of citizens seem to favor it.

CON
This amendment tries to do too much. It should have been broken down into three amendments not only for simplicity?s sake (which would be a good reason all by itself), but also to allow each major part to be considered on its own merits. Remember if you vote for this amendment, you get every provision, not just the parts you like. I mentioned in the PRO section of this breakdown the categories of people who I think will like this amendment. I think it only fair to point out a category of people who I think will hate this amendment. Hate is a strong word, but if you are a local elected official trying to maintain services for the community, and keep his/her budget under control, then you are probably thinking ? Are they out of their minds? Estimated revenue loss to local communities if this amendment is approved is calculated to be $156.2 million in FY 2013-14 alone. Projected out over 3 years the loss could reach as high as $1 billion according to some sources. Compared to the other tax relief amendments on the November ballot, this one appears to be the most costly, and having more of a negative financial impact on local governments than the other 3 amendments combined. Opponents like to also point out that when revenue is lost a taxing entity usually finds another way to raise revenue. So other folks are going to end up paying to cover the lost revenue. No one likes taxes but it appears that everyone likes services. Services cost money. If your local government is struggling as it is to keep the budget balanced, or may be struggling if this amendment is approved, then you might just want to vote no on this amendment.

CONSTITUTIONALITY
I do not foresee a problem in this area no matter how the vote on it turns out.

#5 CHANGES TO THE STATE SUPREME COURT SYSTEM

WHAT IT DOES

  1. Completely changes the structure of the state Supreme Court system by splitting it into two divisions (criminal and civil) composed of five justices in each division. If approved this amendment would require the Governor to appoint three more justices to the state?s high court.
  2. Requires all high court appointees to be confirmed by the state Senate.
  3. Requires the Judicial Qualifications Commission to allow the state House to review its files upon request even if no impeachment action against a judge has actually been initiated.
  4. Allows repeal of a high court rule (not a ruling/decision) by a simple majority instead of the two-thirds vote currently required.

PRO
The American Civil Liberties Union (ACLU) is strongly against this amendment. Some supporters of this amendment claim that it will make the state judicial system more efficient. Other supporters claim that splitting up the court into two divisions would speed up the reviewing of cases which would be especially important in death penalty cases.

CON
The American Civil Liberties Union (ACLU) is strongly against this amendment. Some who oppose this amendment say that it is more about politics than anything else. The vote to put this amendment before the people was highly partisan, with Republicans favoring the changes and Democrats generally not in
favor of it. Some opposers also think that these changes are somehow tied to the anger generated by the striking down of two amendments from the 2010 ballot by the state Supreme Court.

There are a lot of changes that this amendment would cause to happen. Remember citizens that if you vote for this amendment you get all the changes not just the ones you like. So if there is any change that you do not care for then a no vote would be prudent. Do we really need to completely restructure our high court? Do we really need to appoint 3 more judges to it? Is it absolutely important that the state Senate approve all the high court appointees? Wouldn?t that make the appointments more political and polarizing than ever? If you think our high court system is in need of such changes then perhaps a yes vote is called for, but if you don?t think our high court system is broken then why try to fix it?

CONSTITUTIONALITY
In my opinion, I do not find a constitutional problem with any of the proposals of this amendment.
Having said that I would also remind citizens that the ACLU strongly opposes this amendment and if it passes that organization will go over the entire amendment with a magnifying glass to see if they can challenge it.

#6 FLORIDA ABORTION AMENDMENT

WHAT IT DOES

1) Prohibits the use of public funding for abortions or for health benefits coverage that includes coverage of abortion.
2) Provides exceptions as follows:
a) When required by federal law
b) In the case of rape
c) In the case of incest
d) In the case of life endangerment, or physical injury/illness/disorder that would arise from the pregnancy itself.

PRO
This would keep public funds from having to be spent on a lot of abortions, and abortions can be costly. Ask Planned Parenthood. This amendment would not try to outlaw abortions or challenge Roe vs. Wade in any way. If you agree that your tax dollars should not be spent on funding abortions, then by all means vote yes on this amendment.

CON
Opposers of this amendment say it is limiting a woman?s choices when faced with a pregnancy that she does not want but can?t afford to properly abort. If you are on the pro choice side of the abortion argument then you will probably agree with that point of view, and be opposed to the amendment also.

CONSTITUTIONALITY
The exception placed in the amendment ?When required by federal law? makes this amendment pretty much challenge proof. Keep in mind that Obamacare requires that health care coverage providers include coverage provisions for abortion. Passage of this amendment does not present a serious court challenge on constitutional grounds.

#7 WHICH HAD SOMETHING TO DO WITH RELIGIOUS FREEDOM WAS REMOVED FROM THE NOVEMBER BALLOT

#8 THE RELIGIOUS FREEDOM AMENDMENT

WHAT IT DOES

  1. Changes 125 year old wording in the state constitution
  2. Prohibits the denial of any program benefit, funding, or other support to any individual or entity on the basis of religious identity or belief

PRO
No one can argue with the fact that persons of faith and religious organizations do many good works that benefit the citizens of Florida. Religious organizations support hospitals, schools, adoption agencies, and other benevolent activities such as charitable work with the poor and prison visitation programs. Currently the wording in the state constitution prevents any government assistance to such religious organizations or activities. Supporters of this amendment say that its approval would allow some badly needed assistance and would remove the discrimination against religious organizations and activities that currently exist in our state constitution.

CON
At first glance this amendment would seem to be a no brainer. After all who could be opposed to religious freedom? Hmm, you?d be surprised. This amendment if approved could open up a can of worms. How so you might ask. We could have all kinds of religious entities scrambling for taxpayer dollars, and some you might not be so eager to fund. Take a look at the 125 year old wording in the Blaine Amendment that supporters of this amendment take exception to:

?No revenue of the state or any political subdivision or agency thereof shall ever be taken from the public treasury directly or indirectly in aid of any church, sect, or religious denomination or in aid of any sectarian institution.?

What exactly do you find objectionable about that wording? For longer than 125 years religious persons and organizations have been doing good works without the benefit of public funding. They do what they can with what they have, and will continue to do so even if this amendment is not approved by the voters. When you accept government funds, be prepared to accept the rules. regulations, and restrictions that come with them. One of the opposers of this amendment is Kris Anne Hall. Some of our NCF Tea Party members are familiar with her work. She is a hardly a radical, and certainly not anti-religion. She points out that approval of this amendment would have some unintended consequences such as:

?Silence religious organizations and their beliefs in order to receive government funding.?

?Force taxpayers to fund ALL RELIGIOUS activity to include Islamic, Satanic, and cult religious activity.?

?It will give government the ability to promote religious activities through government funding, directly undermining the true principle of separation of church and state; the fundamental principle that government has no place in the church.?

What appears to be a simple amendment supporting religious freedom might turn out to be a deceptive can of worms down the road. If you agree with that then voting no to this amendment would appear to be the logical choice.

CONSTITUTIONALITY
This is one of those amendments that if approved will be looked at very closely by the American Civil Liberties Union (ACLU). The wording should stand up to constitutional challenge, but in the actions this amendment might allow there could be all kinds of problems. Let?s say that Catholic charities received some kind of benefits to assist in their work with the poor. A religious sect goes to court claiming that it does the same type of charitable work and was denied assistance, and on and on it could go.

#9 SURVIVING SPOUSE PROPERTY TAX EXEMPTION

WHAT IT DOES

  1. Authorizes the Legislature to provide Homestead Property Tax Relief to the surviving spouses of the following:
    • a) A veteran who died from service-connected causes while on active duty
    • b) First responders who died in the line of duty
  2. Defines first responders as law enforcement officers, correctional officers, firefighters, emergency medical technicians, or paramedics.

PRO
Being a compassionate people, a lot of us want to make things easier for the surviving spouses of our veterans and first responders. This amendment would certainly provide some financial relief for those spouses. This amendment was sponsored by our Legislature and received unanimous support. Of all the tax exemption relief amendments on this year?s ballot, this one would have the least financial impact on revenue. The amendment does not specify the exact percentage of relief that would be provided, leaving that detail up to the Legislature if the amendment is approved. I am sure surviving spouses that could claim such an exemption would be grateful for whatever financial benefit the approval of this amendment might provide. If you believe surviving spouses of these veterans and first responders should get such a break then you should vote for this amendment.

CON
Keep in mind that whenever you grant any type of a property tax exemption to anyone, there will be a revenue price to pay. Its estimated cost is $0.6 million in fiscal year 2013-14. If that concerns you then you should not approve this amendment.

CONSTITUTIONALITY
There is little or no chance that this amendment would be challenged as unconstitutional. I say little or no because there might be someone out there who thinks this amendment discriminates against surviving spouses of standup comedians. Unfortunately, that is the kind of world we live in today.

#10 THE TANGIBLE PERSONAL PROPERTY TAX EXEMPTION INCREASE

WHAT IT DOES

  1. Increases the exemption from ad valorem taxation on tangible personal property (TPP) from $25,000 to TPP that is less than $50,000
  2. Authorizes the Legislature to allow counties and municipalities to provide additional exemptions by local ordinance subject to general law

PRO
Don?t worry if you don?t know what TPP is. Just ask someone who owns/operates a business in our state and they can probably tell you all about it. I am sure our Governor really likes this amendment. He has been trying to attract more business to Florida since he got elected. Supporters of this amendment claim that because of the current state of our economy, any help we can give to businesses, especially small businesses, is a good thing. Governor Scott would probably tell you that reducing tax burdens on business attracts more business to our state. So if you are pro business, and/or agree with the supporters of this amendment, then I guess they can count on you voting yes for amendment #10.

CON
Keep in mind that whenever you grant any type of a property tax exemption to anyone, there will be a revenue price to pay. It is estimated that the loss in local revenue would be $20.1 million in fiscal year 2013-14. Some opponents of this amendment like to point out that Florida already has one of the lowest tax burdens in the country. Others say that the provision to allow counties and municipalities to grant even larger TPP tax exemptions is even more problematic. Larger more financially sound taxing entities would be in a better position to offer these additional tax exemptions.That would put smaller taxing entities with smaller tax bases in a difficult competitive position when it comes to attracting new business. Still others like to point out that when revenue is lost a taxing entity usually finds another way to raise revenue. So other folks are going to end up paying to cover the lost revenue. No one likes taxes but it appears that everyone likes services. Services cost money. If your local government is struggling as it is to keep the budget balanced, or may be struggling if this amendment is approved, then you might just want to vote no on this amendment.

CONSTITUTIONALITY
I do not foresee a problem in this area no matter how the vote on it turns out.

#11 ADDITIONAL HOMESTEAD EXEMPTION FOR LOW INCOME SENIORS

WHAT IT DOES

Authorizes the Legislature to allow counties and municipalities to grant an additional homestead tax exemption equal to the assessed value of the homestead property to senior citizens who meet the following criteria:

  1. Owns real estate homestead property with a value of $250,000 or less
  2. Has maintained permanent residence on the property for not less than 25 years
  3. Is at least 65 years old
    4) Has a low annual household income as defined by general law (most sources I have researched indicate that this would currently be income that does not exceed $27,030)

PRO
Introduced by two legislators from south Florida, this amendment was unanimously supported by both houses of the Legislature. Being the compassionate people we are, we don?t want our senior citizens to lose their homes because they can?t pay their property taxes. Therefore, this amendment tugs at our heart strings and makes us want to vote yes. Keep in mind that all it does is authorize the Legislature to allow counties and municipalities to grant the exemptions. It would still be up to those taxing entities to decide whether to grant such a revenue reducing exemption. So if you think it is a good idea then you should vote for this amendment, and then pressure your local taxing authorities to take further action if the amendment is passed.

I do not see this as a concern.

#12 CHANGES TO STUDENT REPRESENTATION ON THE BOARD OF GOVERNORS OF THE STATE UNIVERSITY SYSTEM

WHAT IT DOES

  1. Directs the Board of Governors of the state university system (hereafter referred to as the Board) to create a new council made up of the student body presidents from all 11 state universities.
  2. Directs this new council to appoint/elect a Chairperson
  3. That Chairperson would then become a student body representative on the Board and replace the current representative which has been the President of the Florida Student Association (FSA)

PRO
I believe most citizens would agree that it makes sense to have student representation on a Board that oversees the state university system. Supporters of this amendment say that it would provide for a better representation for the students than the current method. This amendment was proposed by the State Legislature and had overwhelming support. A case can be made that all student body presidents would be able to have input to the Chairperson of the council created and therefore a broader view on issues concerning state university students might be represented by this method as opposed to having just one person?s (President of the FSA) input.

CON
Some of those opposed to this amendment say that it was introduced for political purposes because some state politicians now see the FSA as being too liberal to represent state university students. This is more government. More government usually means more costs to the tax payer. So I guess it all comes down to whether or not you think this new amendment would be a better way to represent student interests on the Board or not, and if you do, would it be worth any additional cost to implement and maintain such a system.

CONSTITUTIONALITY
There should be no concerns in this area.

Guinea creates 1st human rights ministerial post

CONAKRY, Guinea (AP) ? Human rights groups applaud the creation of a new Cabinet post dedicated to human rights in Guinea, which has one of the worst records in West Africa, following a shocking 2009 massacre.

In that incident peaceful protesters were mowed down by the military inside the national soccer stadium, and dozens of women were gang raped.

Thierno Sow, head of Guinea's largest human rights group, said that it's the first time that human rights occupy such an important place in the Guinea government.

The post was created last week in the wake of a Cabinet reshuffle, which saw the purging of the last three members of the military serving in the government. It finalizes the transition to civilian rule which began after the massacre, when the military agreed to cede power.
